Assault Family Violence – Impeding Breath, Third-Degree Felony

Client’s girlfriend filed a delayed report, alleging client strangled her outside of her parent’s home. Detectives spoke to three neighbors, each of whom stated they observed client arguing with his girlfriend near the passenger side of client’s vehicle, which was parked in the street. Neighbors all heard client’s girlfriend screaming but could not see whether client had his hands around her neck. Police arrest client on a warrant, and a grand jury indicts
Key to Success
Client’s girlfriend told police that client had cut of her ability to breathe, but it would be impossible for her to scream so loudly that neighbors could hear her if she was unable to breathe. Even though client drove away after the argument, client’s girlfriend did not contact police for a week. Client’s girlfriend did not have injuries that would objectively corroborate her story about getting strangled. And we found a potential financial motive for client’s girlfriend to fabricate a story to police. We threatened to go to trial, and prosecutors dismissed the case

Driving While Intoxicated, Class B Misdemeanor

Client stopped for speeding 140mph on the Dallas North Tollway. Trooper indicated that client demonstrated almost all possible clues of intoxication during field sobriety tests. Trooper obtained search warrant to take client’s blood, and client’s BAC was over 0.08.
Key to Success
Trooper admitted under cross examination that he never measured client’s speed at 140mph. Trooper testified that he first observed client driving on DNT when trooper was on the elevated ramp coming from the George Bush Tollway. Trooper had to accelerate up to 140mph to close the significant gap between him and client. Trooper also admitted to writing his report six weeks after arresting client and did not save his dash camera recording. His body camera did not show all of the field sobriety tests, and trooper admitted that he could have scored client inaccurately since he wrote his report so long after the arrest and had little video to review. Trooper also admitted, under cross examination, that he never swore to the facts in his search warrant affidavit to take client’s blood. The judge threw out client’s BAC evidence since the search warrant was unlawful, and the jury did not trust the trooper after he admitted to numerous mistakes. Client found not guilty.

Client stopped for speeding. Officer administers standard field sobriety tests and claims client failed all of them. Client consents to breath test and provides a sample that exceeds the legal limit.
Key to Success
Texas law requires that the breath test operator remain continuously in the presence of the defendant for 15 minutes prior to administering a breath test. In this case, the arresting officer was also the breath test operator, and the officer stepped out of the breath test room, leaving client all alone during the 15-minute waiting period. Instead of re-starting the 15-minute waiting period when the officer returned, he proceeded to administer the test. Due to a clear violation of protocol, the court threw out the results of the breath test. On cross examination, the officer admitted to making numerous mistakes in how he administered and evaluated field sobriety tests. With no alcohol concentration evidence and discredited field sobriety tests, client was found not guilty.

Police stopped client for driving without headlights on near an entertainment district brightly lit with Christmas lights. Officer claimed client failed field sobriety tests and arrested her for DWI. Client consented to a blood draw, and her BAC was over 0.08.
Key to Success
After arresting client, officer read her the statutory warning and requested a specimen of client’s blood. Client asked follow-up questions, and officer unlawfully gave client inaccurate legal advice about potential consequences to her driver’s license. During trial, we convinced the judge that client consented to the blood draw because of the misleading legal advice the officer gave, and the judge threw out the blood alcohol evidence. Client looked good on field sobriety tests, and we attacked the credibility of the officer's evaluation of those tests. With no BAC and a questionable evaluation of field sobriety tests, the jury found client not guilty

Department store personnel called police and accused client of concealing multiple items in a Bogg bag and not paying. Police arrested client for theft.
Key to Success
Client was moving from department to department, adding items to her Bogg bag as she was assembling an outfit along with accessories. Client never came close to exiting the store. Police and store personnel claimed client passed the point of sale without paying, but there is no rule that a shopper must pay for items at the nearest cash register before moving on to another department within the store. We convinced prosecutors that they could not prove that client intended to exit the store without paying, and they dismissed the case.

Violation of Bond Conditions, Class A Misdemeanor

Allegation
Police pulled over client after running a check on the license plate and finding he had an outstanding warrant for assault. The warrant contained predetermined bond conditions, one of which prohibited client from possessing a firearm. Police arrested client on the outstanding assault warrant and charged him with violating bond conditions since he had a gun in the vehicle.
Key to Success
Client was charged with violating an assault bond condition even though he was not yet on bond for the alleged assault. We proved client had no knowledge of the assault warrant nor its bond conditions at the time of his arrest. Without knowledge, it was impossible for client to have knowingly violated a bond condition. We threatened to go to trial, and since prosecutors could not prove the required mental state, they dismissed the case prior to trial.
